1 - IDENTIFICATION AND ACCEPTANCE OF THE GENERAL TERMS OF SALE

The present General Terms of Sale (the "General Terms and of Sale" or “GTS”) apply, without restriction or reserve, to all sales concluded by the Site with private individuals acting for personal purposes ("Customers" or the "Customer"), wishing to acquire the products offered for sale ("Products") by the Site on the www.ejerparis.com website.

The Products offered for sale on the Site are as follows: Home fragrances (scented candles, home fragrance diffusers, candle care kits), Nightwear (pyjamas, shorts, pants, shirts, tops, robes), (vegan silk scrunchies, vegan silk headbands), Home bedding (vegan silk pillowcases).

The main characteristics of the Products, including descriptions, illustrations, dimensions and capacities, are available on the www.ejerparis.com website. The Customer is invited to consult this information before placing an order. The choice and purchase of a Product are the sole responsibility of the Customer. Product offers are subject to stock availability, as indicated when the order is placed.
The General Terms of Sale are permanently available on the www.ejerparis.com website and shall prevail over any other document.

By checking the appropriate box when placing an order on www.ejerparis.com, the customer acknowledges having read and accepted this General terms of Sale.

The information recorded in the Site's computer system is authentic and attests to all transactions carried out with the Customer, unless proven otherwise.

The Products presented on the www.ejerparis.com website are offered for sale in the following territories:

When ordering from a country other than metropolitan France, the Customer is considered to be the importer of the Products ordered.

For Products shipped outside the European Union and French overseas departments and territories, the price will automatically be calculated exclusive of tax on the invoice.

Customs duties, local taxes, import duties or other state charges may apply. These costs are the sole responsibility of the Customer.

2 - CREATION OF AN ACCOUNT

To place an order, the Customer must create a personal account. He/she must register by filling in the form presented at the time of ordering, and undertakes to provide accurate and sincere information, in particular his/her civil status and contact details, including e-mail address. The customer is responsible for keeping his or her information up to date, and may modify it by logging into his or her account. Access to the customer's personal space and order history requires identification by means of a login and password supplied at the time of registration. These identifiers are personal and the Customer undertakes not to divulge them. In the event of disclosure, the Customer assumes responsibility. To unsubscribe, the Customer may access the dedicated page in his/her personal space or send an e-mail to: hello@ejerparis.com. Unsubscription will be processed within a reasonable period of time.

In the event of non-compliance with the General terms of sale and/or use, the Site www.ejerparis.com may suspend or close the Customer's account following an unanswered electronic formal notice. Deletion of the account entails deletion of all the Customer's personal information. The Site is not responsible for malfunctions due to force majeure, interruption for maintenance, or any external event beyond its control. The creation of an account implies acceptance of the General terms of sale.

3 - PRICES

Product prices are those displayed on the www.ejerparis.com website at the time of the Customer's order.

Prices are indicated in Euros, and are presented both exclusive of tax (HT) and inclusive of tax (TTC).

Prices include any discounts offered by the Site on www.ejerparis.com.

These prices are fixed during their period of validity, but the EJER Paris site may modify them outside this period.

Processing, shipping, transport and delivery costs are not included in Product prices. They are invoiced in addition and are detailed on the www.ejerparis.com website at the time of ordering.

The total amount payable by the Customer includes the cost of the Products and these additional charges.

A detailed invoice is sent by the Site to the e-mail address provided by the Customer.

4 - TERMS OF PAYMENT

Payment is made securely using the following methods: 

- Payment by credit card

- Payment by electronic purse (Paypal type)

- Payment by gift card purchased on www.ejerparis.com

The customer must pay the full price of the order at the time of purchase.

Payment information is transmitted encrypted via the secure protocol of the payment service provider approved for transactions on the EJER Paris website.

A payment is considered finalised only after the Site www.ejerparis.com has received payment in full. The Site is not obliged to deliver the Products ordered until full payment has been received, in accordance with the General terms of sale.

Payment using a Paypal electronic wallet:

If the Customer already has an account on the Paypal electronic wallet used by the EJER Paris Site, they can use it to secure their payment without communicating their bank details.

The order will be confirmed once the secure bank payment centre has validated the transaction. For verification purposes, EJER Paris may ask the Customer for additional documents in order to finalise the order. These documents will only be used for this purpose.

Payment by gift card purchased on the www.ejerparis.com website:

Gift cards are on sale on the Site, with predefined amounts to be chosen at the time of purchase. These gift cards will be sent to the Customer or the recipient of their choice by e-mail.

Gift cards are non-refundable and are valid for purchases on the Site for one year from the date of activation. Once used in full, the card is deactivated.

To use a gift card when making a payment on the Site, simply enter the code provided in the gift card confirmation e-mail.

If the total amount of the order is greater than the amount of the gift card, the Customer must make the payment using the other means of payment offered on the Site. If the total amount is less than the amount of the gift card, the Customer may proceed with payment and use the remaining balance when making their next purchase on the Site.

5 - DELIVERY

Products ordered by the Customer are delivered to Metropolitan France and to the following countries: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Romania, Serbia, Slovakia, Slovenia, Spain, Sweden, Switzerland, Turkey, United Kingdom, United States of America.

Delivery charges vary according to the destination country. For specific details on delivery charges by country, the Customer may refer to the "Delivery and Returns" section of the Site. The total price displayed on the last screen of the order process, as well as in the order confirmation received, includes taxes and delivery charges.

Confirmed orders are processed from the first working day following the order date. For orders placed on Saturdays, Sundays or public holidays, processing begins on the following Monday or the first working day. Delivery times, expressed in working days, depend on the destination (the Customer is invited to consult the list of destinations in the "Delivery & Returns" section of the EJER Paris website). Delivery times are calculated from the time the parcel leaves our warehouse. 

If the EJER Paris Site does not respect the agreed delivery date or deadline, the customer must first ask the Site to respect the deadline within a reasonable additional time before cancelling the contract. To do this, the customer must send an e-mail to the Site EJER Paris. If the Site does not comply with this new request, the contract may be cancelled. 

If the contract is cancelled, the Site must reimburse the customer in full within 14 days of the cancellation. In the event of product unavailability, the customer will be informed promptly and may choose between a full refund within 14 days or an exchange of the product.

Deliveries are made by an independent carrier to the address indicated by the Customer. If the Customer chooses his own carrier, delivery is deemed to have taken place as soon as the Products have been handed over to the carrier without reservation. The Customer thus acknowledges that responsibility for delivery lies with the carrier and not with the Site www.ejerparis.com.

For specific packaging or transport requests accepted in writing by the Site, additional charges may be applied, based on an estimate accepted by the Customer.

The Site entrusts the delivery of products ordered to various carriers. Upon receipt, the Customer must sign the delivery note issued by the carrier. If the delivery cannot be made for various reasons (absence of the Customer, incorrect address, missing access codes, impossible access to the delivery location, etc.), the carrier will leave a delivery notice and/or send an e-mail to the Customer. This notice informs the customer of the next delivery attempts and the possibility of collecting the parcel, often from a nearby relay point.

If delivery attempts fail, the parcel is returned to the Site, which keeps it for 30 days at the customer's disposal. Orders may be delivered in shipments if certain items are temporarily unavailable. In this case, the Site will contact the customer by e-mail to inform them of this and propose a new delivery date for the missing items.

Any additional shipping costs associated with split deliveries are borne by the Site and are not invoiced to the Customer. If the Customer refuses the proposed new delivery date, the Site will reimburse the undelivered items within 14 days of receipt of the Customer's written notification of refusal.

At the time of delivery, the customer is invited to carefully examine the products and their packaging to check that they are not damaged, and to sign the delivery note given to him by the carrier at the time of delivery. If any damage is found, the customer must refuse delivery. In this case, the Site will reimburse the damaged products and delivery charges in full within 14 days of receipt and registration of the return of the damaged products.

On receipt of the order, the Customer must check the condition of the Products delivered and report any problems within 24 hours to hello@ejerparis.com, together with all supporting documents.

6 - ORDERS

6.1 - Placing an order

Ordering on the Site must follow the procedure established by EJER Paris, presented by a series of steps on different pages that the customer must follow to finalize his order. Customers must select the Products they wish to order on the www.ejerparis.com website, following the steps below: 

- Select the product quantity on the product page 

- Add the product(s) to the shopping cart 

- Log in or create an account 

- Select shipping and payment method 

- Proceed to payment 

- Confirm order

The customer must check the details of his order, its total price, and correct any errors before validating his order. Customers are responsible for checking the accuracy of their order, and must report or rectify any errors immediately.

The order is recorded on the www.ejerparis.com website when the Customer ticks the box accepting the General Terms of Sale and validates his order.

By validating his/her order, the Customer accepts all the General Terms of Sale and the general terms and conditions of use of the www.ejerparis.com website.

The sale is confirmed by a confirmation e-mail from the EJER Paris site, sent on receipt of full payment. An order placed and confirmed on www.ejerparis.com establishes a distance contract between the Customer and the EJER Paris website. In the absence of proof to the contrary, the Site's data serves as proof for all transactions with the Customer.

The EJER Paris Site reserves the right to cancel or refuse an order in the event of a dispute concerning a previous payment with the Customer. Customers can track the status of their order on the www.ejerparis.com website.

6.2 - Order tracking 

When the order is validated, a tracking number is assigned to the Customer. This number enables the Customer to track the progress of the delivery via the website of the carrier chosen by the Site. The address of the carrier's website is communicated to the Customer in the order confirmation e-mail. Customer Service is also available for any assistance concerning order tracking.

6.3 - Order modification 

Once the order has been validated by the EJER Paris website, no modification is possible.

6.4 - Order cancellation 

Once the order has been confirmed on www.ejerparis.com, it cannot be cancelled, except in the event of a right of withdrawal or force majeure.

7 - CUSTOMER SERVICE

The customer may contact EJER Paris customer service at any time by e-mail hello@ejerparis.com, stating his name, telephone number, the subject of his request and the number of the order concerned.

8 - RESERVATION OF OWNERSHIP

Until full payment has been received by EJER Paris, the products ordered remain the property of EJER Paris. However, upon delivery of the products to the address specified in the order, the customer assumes all risks, such as loss, theft or damage.

9 - RIGHT OF WITHDRAWAL

In accordance with articles L. 121-16 et seq. of the French Consumer Code, the Customer has 14 days from receipt of the product purchased on the Site to inform Customer Services of his/her intention to return the product.

To make a return, the Customer must contact Customer Service by e-mail at hello@ejerparis.com to inform them of their decision to withdraw. Any returns made after 14 days will be refused and returned to the customer at their expense. Cash on delivery returns are not accepted, whatever the reason. The cost and responsibility of the return are the responsibility of the customer. To be eligible for an exchange or refund, the product must be returned in its original packaging, in good condition, unworn, unused, unbroken, with all its labels, accessories and a copy of the invoice to the postal address given to you by customer service to validate your return request. No justification is required for the return, but only the return costs remain at the customer's expense.

EJER Paris cannot be held responsible for loss, theft or damage during the return of the parcel. Packages without clear Customer identification will be refused.

For reasons of security and peace of mind, we strongly recommend that you send products by registered mail (COLISSIMO, UPS, FEDEX, DHL, etc.). The tracking number must be communicated to Site EJER Paris. 

After receipt of the returned product, an e-mail confirmation will be sent by customer service.

In the event of a compliant return, EJER Paris will reimburse the Customer within a maximum of 14 days to the account linked to the payment card used for the purchase, excluding any initial delivery charges and customs duties.

Also, customers who have paid for their order with credit notes or gift cards will be reimbursed with credit notes or gift cards, excluding any initial delivery charges and customs duties.

10 - WARRANTY AND LIABILITY

Products sold by the Site benefit from a guarantee of conformity for Products ordered which do not correspond to the order as soon as the product is received by the customer. The customer must inform the Site within 24 hours of receipt of the Products.

The Site may not be held liable in the event of non-conformity with the legislation of the country of delivery or import. It is the customer's responsibility to check the regulations of the importing country with the local authorities.

EJER Paris cannot be held responsible for non-performance of the contract caused by the Customer, by an event of force majeure recognized by the courts, or by the unforeseeable and insurmountable action of a third party.

The information published by Customers on the Site is not the responsibility of EJER Paris. Any damage caused to a third party by this information remains the exclusive responsibility of the Customer who published it.

The Customer acknowledges the limitations and risks associated with the Internet, particularly in terms of data security, availability and integrity. EJER Paris does not guarantee continuous, error-free availability of the Site, which may be temporarily unavailable for maintenance or technical improvements.

EJER Paris may not be held liable for any use of the Site in breach of the General Terms of Sale, nor for any prejudicial actions caused to a Customer or a third party by another Customer. In the event of EJER Paris being held liable for the conduct of a Customer, the latter undertakes to cover all costs incurred by EJER Paris, including legal fees.

The Customer is responsible for the content published on the Site and undertakes not to violate the rights of third parties, particularly in terms of intellectual property, respect for privacy, or respect for public order. In the event of such infringement, EJER Paris reserves the right to exclude the Customer and to remove the litigious content without notice. As host, EJER Paris is not required to actively monitor the content of customers, users of the Site. However, if EJER Paris is called into question for content published by a Customer, the latter undertakes to cover all costs associated with defending EJER Paris.

The search for amicable solutions does not interrupt the legal or contractual warranty periods.

12 - LINKS TO OTHER SITES

Links on the Site may lead to external sites not managed by EJER PARIS. These links are provided for the user's convenience to facilitate access to online resources. By following these links, users leave our Site and use third-party sites at their own risk, in accordance with their terms of use.

EJER PARIS has no control over the content or terms of use of these third-party sites and is not responsible for their content.

Furthermore, EJER PARIS does not endorse the terms of use or the content of such third-party sites.

The Site may also display promotional links or advertisements leading to external sites not maintained by EJER PARIS.

We encourage users to inform us of any links on our Site to content that violates laws or ethical standards.

No link to our Site may be established without our prior written consent.

13 - INTELLECTUAL PROPERTY

The content of the www.ejerparis.com site belongs to the Site and its partners, and is protected by French and international intellectual property laws. Any reproduction, even partial, of this content is strictly prohibited and may constitute an infringement of copyright.

14 - APPLICABLE LAW - LANGUAGE

This General Terms of Sale and the transactions arising therefrom are governed by and subject to French law.

These GCS are written in French. In the event of translation into other languages, the French version shall prevail in the event of dispute.

15 - DISPUTES

For all complaints, please contact our customer service department at the e-mail address given in ARTICLE 1 of this general terms of sale.

Customers are also informed that they may choose to have recourse to conventional mediation by contacting the mediation organizations specific to their sector, or opt for other methods of dispute resolution, such as conciliation.

All disputes relating to purchase and sale transactions carried out in accordance with this general terms of sale, which are not resolved amicably or by mediation with the Site, will be brought before the competent courts in accordance with the applicable rules of law.

16 - MODIFICATIONS OF THE GENERAL TERMS OF SALE

The EJER Pairs Site may, at any time, modify or interrupt all or part of the content or services of the Site, temporarily or permanently, without notice.

In addition, Le Site EJER Pairs may change the location of the Site on the Internet and update this General Terms of Sale at any time without notice. The Customer is therefore advised to consult the General Terms of Sale on a regular basis.

The Customer acknowledges that Le Site EJER Pairs shall not be held liable for the consequences of modifications, interruptions or cessations of the Site.

The Customer is advised to keep a copy of the General Terms of Sale, either electronically or in hard copy, for future reference during the term of the contract.

17 - ACCEPTANCE OF THE GENERAL TERMS OF SALE BY THE CUSTOMER

The Customer declares that he has read and understood the General Terms of Sale.

By registering on the Site, the Customer confirms his acceptance of the General Terms of Sale, which binds him contractually according to the terms in force at the time of his registration.

The General Terms of Sale applicable to the Customer are those in force at the date of his/her order. Upon request, a dated copy of the General Terms of Sale may be provided to the Customer. Subsequent modifications to the General Terms of Sale will not affect previous orders, except with the express agreement of the Customer in question.
